PATNA: Ashok Kumar Sinha (73), a practising lawyer in the Patna high court, had to struggle for seven years to get his house vacated from one Sanjay Sinha, who was also an advocate.
His is not a solitary example of problem faced by landlords in getting their property back from the tenants. A large number of people, especially those in their twilight years, are fighting legal battle for years to save their properties.
Sources in the local court said hundreds of such cases of dispute between the landlords and the tenants are at different stage of hearing. Some cases are more than 10-15 years old.
Ashok had requested his tenant for around 20 years, Sanjay Sinha, to vacate his house in 2005. However, Sanjay did not pay any heed. Finally, Ashok filed a case (no. 70/2009) in the civil court against Sanjay for eviction from his house. The tenant delayed eviction by not appearing in the court during hearing on several occasions.
Finally, the house on Fraser Road was vacated by Sanjay on May 27 in the presence of nazir of the civil court and cops of Kotwali police station. “I am the lucky few in the city who have got their tenants evicted in their lifetime. A lot many cases of eviction are pending in the court,” said Ashok.
In another case of tenancy dispute (no. 36/2011), Dr Shankar Nath vs Binay Kumar, the former is struggling for last five years to get the property vacated.
Shankar, who is presently under treatment at a hospital in Pune, said “The tenant is not vacating the house for the past five years. The case is in the court. I am in Pune now, undergoing medical treatment.”
Yet another victim is Batuk Narayan Prasad Singh (80), who is bedridden due to medical reasons. “I am a businessman and have a property on Fraser Road. I have filed a number of cases (no. 49/2011, 4/2015, 5/2015, 40/2005) in the last 11 years against my tenants. My tenants have sublet the space in the commercial building to other people against the lease agreement. Every year, I have to bear huge financial expenses because of this dispute. I am 80 years old and bedridden. I don’t know what will happen to my hard-earned property,” said Singh.
Ashok, who is the advocate of Singh, said tenants usually delay judgments by various means, waiting for the demise of the landlord. “I feel that a land rent tribunal should set up by the state government to settle disputes quickly,” said Ashok.
